Is this a high conflict emotional matter?

High conflict does not necessarily mean big arguments and loud disruptive situations, but rather is more simply defined as one's approach to problem solving and resolution, behaviors and situations that lend themselves to added drama, and increase rather than reduce or resolve the conflict.

Use the statements below for some general guidance.

  • Overall the parties' conversations have been calm and rational
  • The parties have had multiple heated conversations in which emotions ran high
  • The parties cannot talk without fighting
  • There is a lot of emotional attachment by the parties to the issues to be determined or the intangible and tangible assets at stake, as defined by the parties.
